Terms of Service
Last updated: [DATE]
These terms apply to the use of this webshop and purchases from Halima's Fashion.
Mandatory consumer rights always take priority over conflicting provisions in these terms.
1. Seller information
Legal name: [LEGAL BUSINESS NAME]
Trading name: [STORE NAME]
Address: [REGISTERED ADDRESS]
Email: [CUSTOMER SERVICE EMAIL]
Telephone: [PHONE NUMBER]
Chamber of Commerce: [KVK NUMBER]
VAT number: [VAT NUMBER]
2. Scope
These terms apply to visitors and customers ordering through our webshop.
By placing an order, you confirm that you can legally enter into the contract and that the information you provide is accurate.
Consumer-only protections may not apply to purchases made primarily for business purposes.
3. Products
We take reasonable care to describe product dimensions, materials, colours, features and availability accurately.
Screen colours may differ from actual products. Handmade products and natural materials may have reasonable variations. Product images are illustrative unless stated otherwise.
Please check product-specific sizing, care and compatibility information before ordering.
4. Prices and additional costs
Prices are displayed in [CURRENCY] and [INCLUDE/EXCLUDE] applicable VAT.
Delivery charges and other mandatory costs are shown before you submit your order.
Customers outside [CUSTOMS TERRITORY] may be responsible for disclosed import duties, taxes and customs charges.
We may correct obvious pricing or typographical errors. We will request your confirmation before processing an order at a corrected price.
5. Orders and contract formation
Checkout allows you to review and correct your order before submitting it.
Your order represents an offer to purchase. An automatic acknowledgement confirms receipt but does not necessarily mean that we have accepted the order.
The contract is formed when we send an order acceptance or confirmation, or when we dispatch the goods, as explained during checkout.
We may reject or cancel an order for legitimate reasons, including:
- Product unavailability
- Payment failure
- Suspected fraud
- Delivery restrictions
- An obvious pricing or product-information error
If we cancel an order after receiving payment, we will refund the amount paid.
6. Payment
Available payment methods are displayed during checkout and handled by the indicated payment provider.
You must use a payment method that you are authorised to use.
Payment-provider processing times do not reduce your statutory refund rights.
7. Delivery
Available delivery destinations, costs and estimated delivery times are displayed during checkout or on our Shipping page.
You are responsible for checking the delivery address before submitting the order.
We will deliver within the agreed period or the period required by applicable law. Contact us if an order is delayed.
For consumers, the risk generally passes when you or a nominated third party physically receives the goods.
8. EU/EEA right of withdrawal
EU/EEA consumers purchasing at a distance generally have 14 days after receiving the goods to withdraw from the purchase without providing a reason.
When products from one order are delivered separately, the withdrawal period generally begins after the final product is received.
Notify us using an unambiguous statement sent to [RETURNS EMAIL OR FORM]. You may use the statutory model withdrawal form, but this is not mandatory.
After notifying us, return the goods within 14 days to:
[RETURN ADDRESS]
You are responsible for direct return costs [UNLESS WE STATE OTHERWISE OR DID NOT PROPERLY DISCLOSE THIS].
You may inspect products as you would in a physical shop. You may be responsible for diminished value caused by handling beyond what is necessary to establish the product’s nature, characteristics and functioning.
We will refund eligible payments, including the least expensive standard outbound delivery method, within 14 days after receiving your withdrawal notice.
We may withhold reimbursement until we receive the goods or you provide evidence that they were returned, whichever occurs first.
Refunds are made using the original payment method unless agreed otherwise.
9. Withdrawal exceptions
The withdrawal right may not apply to legally exempt products, including:
- Products made to your specifications
- Clearly personalised products
- Rapidly perishable products
- Sealed products unsuitable for return for health-protection or hygiene reasons after being unsealed
We apply an exception only where its legal requirements are satisfied and identify applicable exceptions before purchase.
These exceptions do not remove your rights concerning defective or non-conforming products.
10. Returns and exchanges
Follow the instructions on our Returns & Exchanges page.
Any voluntary return or exchange policy offered beyond your statutory rights applies according to its stated conditions and does not reduce mandatory consumer rights.
Only return goods using an address and method authorised by us.
11. Defective or non-conforming products
Products must conform to the sales contract.
EU consumers have a minimum two-year legal guarantee for faulty or non-conforming goods. Dutch or other applicable national law may provide additional protection.
Depending on the circumstances, remedies may include:
- Repair without charge
- Replacement without charge
- A price reduction
- Termination of the contract and a refund
Contact [CUSTOMER SERVICE EMAIL] and include your order number and a description of the problem.
Any commercial warranty is additional and never replaces the legal guarantee.
12. Accounts and acceptable use
You are responsible for keeping your account credentials confidential.
You must not:
- Interfere with webshop security
- Introduce malicious software
- Scrape the website at an unreasonable volume
- Infringe intellectual-property or privacy rights
- Commit fraud
- Use the webshop unlawfully
We may reasonably restrict access where necessary to protect customers, our services or legal rights.
13. Intellectual property
The webshop and its branding, text, graphics, photography and software belong to us or our licensors and are protected by applicable intellectual-property laws.
You may use the webshop for personal shopping. You may not reproduce, distribute or commercially exploit protected materials without permission unless permitted by law.
14. Liability
Nothing in these terms excludes or limits liability or consumer remedies that cannot legally be excluded.
Subject to this rule, we are not responsible for:
- Loss that was not reasonably foreseeable when the contract was formed
- Loss caused by inaccurate information supplied by you
- Business losses suffered by someone purchasing as a consumer
Any limitation is interpreted according to applicable mandatory law.
15. Events outside our control
We are not responsible for delays caused by events outside our reasonable control.
We will take reasonable steps to minimise the effects, inform affected customers and resume performance as soon as reasonably possible.
Mandatory cancellation and refund rights remain unaffected.
16. Privacy
Our Privacy Policy explains how we handle personal data.
Optional analytics and marketing technologies are controlled through our cookie settings where applicable.
17. Complaints and disputes
Send complaints to [CUSTOMER SERVICE EMAIL] and include your order number and relevant details.
We aim to acknowledge complaints within [NUMBER] business days and provide a substantive response within [NUMBER] days.
Applicable consumer dispute-resolution body:
[ADR BODY AND WEBSITE, IF APPLICABLE]
18. Governing law
These terms and purchase contracts are governed by the laws of [COUNTRY].
If you are a consumer living in another country, this choice does not deprive you of mandatory protections provided by the laws of your country of residence.
Disputes may be brought before courts having jurisdiction under applicable consumer law.
19. Changes and severability
The version accepted when you placed an order applies to that order.
Updated website-use terms apply prospectively. We will publish the latest update date.
If one provision is found invalid or unenforceable, the remaining provisions continue to apply.
We may transfer our rights or obligations only where legally permitted and without reducing mandatory consumer protections.
